A settlement has been reached with Avis Budget Group, LLC Inc., in two class action lawsuits, Schwartz v. Avis Rent A Car Sys., LLC, 11 Civ. 4032 (D.N.J.), and Klein v. Budget Rent A Car Sys., Inc., 12 Civ. 7300 (D.N.J.), filed in federal district court in New Jersey, claiming that Avis and Budget should not have charged a Frequent Traveler Program Surcharge to members of the Avis Preferred Service Program and the Budget Rapid Rez With Fastbreak Program in connection with online rental vehicle reservations in which those members received frequent-flyer miles from Avis and Budget travel partners. This Surcharge was typically a $0.75/day charge for accepting the frequent-flier miles that Avis and Budget invited its Avis Preferred and Budget Rapid Rez members to accrue when reserving rental vehicles. Avis and Budget deny all claims and any wrongdoing in connection with the imposition of this Surcharge.

All members of the Avis Preferred Service Program who rented a vehicle in the United States through www.avis.com, and paid a Frequent Traveler Program Surcharge for receiving frequent-flyer miles from any of Avis’s travel partners at any time between July 14, 2005 and June 14, 2012, are members of the Avis Settlement Class. All members of the Budget Rapid Rez With Fastbreak Program, who rented a vehicle in the United States through www.budget.com, and paid a Frequent Traveler Program Surcharge for receiving frequent-flyer miles from any of Budget’s travel partners at any time between November 27, 2006 and February 17, 2013 are members of the Budget Settlement Class. It is possible to be a member of both Settlement Classes. The members of the Settlement Classes are eligible to submit a claim for one or more discounts on future vehicle rentals or a cash award.

If the settlement is approved by the Court, you may qualify for your choice of either (a) a 10% discount off of the standard Avis or Budget RAC rate for future vehicle rentals made through www.avis.com and www.budget.com, which may be used one or more times, or (b) a cash payment. You must choose one of these two options, however, and cannot get both. However, if you are a member of both the Avis Settlement and the Budget Settlement Class, you can seek one form of relief from Avis and a different form from Budget if you choose. Fairness Hearing

The Court held a Final Approval Hearing before the Honorable Jose L. Linares on May 25, 2016 at 10:00 AM EST., in Courtroom 5D of the United States District Court for the District of New Jersey, Martin Luther King Building & U.S. Courthouse, 50 Walnut Street, Newark, New Jersey. At this hearing, the Court considered whether the settlement is fair, reasonable, and adequate.
